NJSAs: Death to the Irrevocable Trust
Irrevocable Trusts aren’t so irrevocable as one may think. The Wisconsin Statutes allow an interested person to enter into a nonjudicial settlement agreement (“NJSA”) to alter specific provisions of an irrevocable trust. NJSAs provide a powerful and useful tool in the administration of a trust, but estate planners must be aware of the procedure, considerations and risks of NJSAs. In this presentation, we’ll discuss the basics and structure of NJSAs and considerations to make while drafting NJSAs.
